Terms & Conditions / Hire Agreement

  • By accessing and using the My Secret Wardrobe website at www.mswthelabel.com, you are accepting and consenting to the practices in these terms of use. My Secret Wardrobe reserves the right to change these terms and conditions from time to time at its sole discretion.

Definitions 

  • In these Terms of Use “you” and “your” refer to all users of this Website and “My Secret Wardrobe" (“we’, “us”, ‘’MSW’’ and “our”) refers to Pty Ltd (ACN 6 5289 2512). References to users must be read as being also a reference to customers of My Secret Wardrobe.

Clearance Sale & Accessories

  • Second hand items that are purchased to keep (i.e. - not hired) are final and cannot be returned for a refund or exchange.
  • Credit notes/gift cards cannot be used to purchase clearance stock or hire MSW exclusive pieces.
  • Any orders placed using a credit note/gift card will be cancelled.
  • Please note Clearance Sale items will be processed within 3-5 business days of processing.
  • Please be aware many of these dresses are second hand, please email info@mswthelabel.com.au or contact the store directly if you have any questions regarding the condition of a particular dress.
  • All accessories including Booby Tape and Mod Squad Basics cannot be returned for a credit note or refund.

Legally Binding Contract

  • These Terms of Use constitute a binding legal contract between you and My Secret Wardrobe.
  • These Terms of Use apply to you whether you are browsing or are a customer of My Secret Wardrobe.
  • The Terms of Use in force at any time are published on the website and you will be taken to have accepted them by accessing or using the Website.
  • If My Secret Wardrobe develops revised terms of use then on their publication on the Website they will supersede those they replace.
  • If you subsequently access or use the Website you will be taken to have accepted the revised terms of use.
  • Specific Website offerings, incentives, areas, or section may also have additional guidelines which govern your use of this Website.
  • You must comply with them in addition to these Terms of Use.
  • This agreement contains all of the terms and conditions regarding your hire of products from My Secret Wardrobe via the website www.mswthelabel.com
  • You agree that hire from our business is subject to all our website terms and conditions of use and privacy policy. (These are available on our website and are subject to change from time to time.)
  • You agree that you are renting products and ownership of the product remains with My Secret Wardrobe at all times.
  • Our products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor.
  • By clicking “I accept” hire agreement button you represent that you are over 18 years and are authorised to use the chosen method of payment with the purpose of renting the products on the order.

Payment Terms

  • The “hire fee” for the products will be the hire fee and delivery fees and any additional charges listed on the website in relation to your hire of products.
  • When you order a product you authorise My Secret Wardrobe to charge your payment method for your hire fee and/or bond.
  • In addition to your hire order for a product, you authorise My Secret Wardrobe to charge your payment method up to an amount to 100% of the entire original retail value of the product as set in the “retail value” on the website. (Provided we only charge your payment method when you have not upheld your commitment to us as set forth in the hire agreement below.)
  • In the event an invoice is issued for payment for any reason than payment shall be due within seven (7) days of the date of the invoice.
  • We may ask for photo ID, credit card details or other forms of identification.
  • We can refuse the right to hire if you are unable to provide the requested identification or document(s). If we have requested this information, it is your responsibility to provide this information immediately.
  • In the event we are unable to fulfil your hire or delivery on time due to the information not being provided a credit only will be applied, no refunds will be given.

Sizing Issues & Faulty Garments

  • If a product doesn’t fit, you or is not right for any reason you must return your hire back within 24 hours of delivery and we will issue a credit note once the dress is returned to us in its original condition upon being provided with proof the dress rented was returned within 24 hours of the delivery time/date.
  • The term “unworn” will be determined by My Secret Wardrobe and must be fulfilled prior to a credit being issued.
  • You must inspect your dress, notify us and send through photos of any damage within 4 hours of delivery of the garment, you may be responsible for the damage if we are not notified within this time period or sent photo evidence of the damage.
  • We highly recommend posting at a post office where the parcel is scanned.
  • If the dress arrives back to us late and you are unable to provide proof, it was posted within the 24 hours of delivery then you will not be entitled to a refund/credit note.
  • You understand HIRE OR SALE pieces can and most commonly are second hand and there are indications of wear and tear.
  • You understand if we think a dress has wear and tear and still post the dress it is still titled under wearable.
  • If you have booked a dress in advance and we think it can no longer be worn we will notify you for an exchange or credit note.
  • You understand dress/s are usually hired back-to-back (e.g. week to week) and there could be an event where the previous customer has not returned the dress in time for the next booking to receive it and you are entitled to a credit note or exchange NO REFUND.

Shipping Details

  • All parcels are marked authority to leave. If you require your parcel to be signed for, you must specify this in the delivery instructions at, check out.
  • Delivery is available Australia Wide.
  • Shipping costs will vary on dress weight and location of delivery. Our customer representative will call to confirm these costs before charging you. 
  • PLEASE NOTE: This rate only covers items sent in the same order. If you are booking more than one dress and they are for different weekends you must place your bookings separately and pay the shipping amount separately in each order.
  • Your delivery can be delivered to you between 7:00am and 8:00pm on the requested day of delivery or earlier.
  • Your hire period starts from the time the courier attempted first delivery and credits will not be issued for late delivery where you have not been available to accept delivery.
  • When placing an order, you automatically give us authority to leave your parcel in a safe place. (If you do not wish to grant us this authority you must clearly outline this in the delivery instructions at checkout.)
  • You understand and agree that this authority to leave gives us and/or our selected couriers permission to leave the Order in question unattended by the front door, in the letterbox – or, where applicable, at the reception or concierge’s desk – of the delivery address without obtaining a signature confirming delivery at the delivery location.
  • In such circumstances, you understand and agree that by granting us authority to leave, we and our couriers are released of all responsibility and liability for the orders delivered and left unattended, and that this responsibility and liability transfer to you on delivery.
  • We do not take responsibility for orders where an incorrect/ ineligible address has been provided. (If you have supplied an incorrect address, you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us.)
  • In the instance where a parcel is unable to be delivered in time due to AusPost being unable to gain access and/or leave the parcel in a safe place and you have not provided delivery instructions you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us.
  • If you have supplied an address that has a redirection service set up and your parcel is not delivered in time you will not be entitled to a refund.
  • Once the parcel has been dispatched if you redirect it in anyway you will not be entitled to a refund if it does not arrive by the chosen delivery date.
  • Redirecting a parcel will increase the delivery time by approximately 2-5 business days. - By choosing signature on delivery you are accepting that anyone on that premises can sign for your parcel, once the item is signed for responsibility and liability transfer to you.
  • We aim to deliver hires as early as possible to mitigate any postage delays.
  • Your delivery may occur up to ten (10) days prior to your chosen delivery date.
  • Please ensure you provide a permanent address where there will be somewhere safe to leave a parcel or someone to accept the parcel up to 10 days prior to your chosen delivery date.
  • In the rare occasion that the dress is delivered after your return date you are still required to return the dress as soon as possible (no later than 48 hours after delivery). If you require additional time to return the dress due to a late delivery, please contact info@mswthelabel.com or call the store directly.
  • If a dress is not returned you are liable for 100% of the retail price of the dress, you may also be liable for late fees if you do not return the garment on your return due date.
  • It is therefore required that you select a permanent address that someone will be available at in the unlikelihood of the dress not being delivered as per your chosen date.
  • Any last minute hires (orders placed less than 48 hours before being dispatched) that do not arrive in time will not be entitled to a credit note or a refund. As this would be deemed as placing a LAST MINUTE order and MSW holds no liability.

Please note we aim to deliver every item as quickly as possible. If you order in advance and the dress does not arrive to you in time you will be entitled to a full refund.

 

Instore Pickups

  • If you would like to pick up, either select pickup on checkout or we ask that you visit our store and book in store or call our store so we can confirm the booking with you online.

Returns

  • With delivery of your product, pre-paid return packaging is provided.
  • Please ensure that you place your dress inside the postage bag and drop it at your nearest Post Office by 12pm on the return day of your hire stated on your return card placed inside your order. - My Secret Wardrobe will not take responsibility for lost item(s) returned in Australia Post Boxes.
  • If you loose your return packaging it is your responsibility to return the garment via trackable express post to My Secret Wardrobe at 214 Waldron Road, Chester Hill, NSW 2162, Australia. 
  • You must provide tracking details and photo of addressed satchel to info@mswthelabel.com in order to avoid further borrowing charges.
  • If you return your item(s) via an Australia Post Outlet (highly recommended) where it has been scanned over the counter as proof of lodgement then the article will be deemed as returned and we will accept responsibility for the article after the first scan.
  • If you return your item(s) via an Australia Post Box and the item(s) is not scanned and is lost by Australia Post then you accept responsibility for this loss and will be required to pay the retail cost of the item(s) in addition to the hire fee already paid.
  • If your hire period ends on a Sunday or public holiday simply slip your dress in the return satchel provided you can return across the counter at the Post Office the next business day.
  • If you are hiring in store you have the option to drop the dress back off in-store or you can post the dress back in a EXPRESS satchel paid by you. If dress arrives late you will incur a late fee. Please refer to Late Fee Policy
  • If posting back you must post your hire back on the last day of your hire by 1pm and the same terms and conditions above apply.
  • If you are bringing your dress back you must bring your dress back by the agreed date and time otherwise late fees apply.

Cleaning

  • Professional cleaning is included in your hire and you agree that no attempts will be made to clean, alter, iron/press garment/s (unless otherwise arranged).
  • All garments are professional steamed prior to sending however can become creased in the post or garment bags.
  • Certain fabrics are more prone too wrinkles though, and if you receive a dress with slight creases, please try steaming the garment on low heat. Alternatively, you can hang the dress in a steamy bathroom and the steam will de-crease it.
  • If you need further assistance please contact a staff member directly.
  • My Secret Wardrobe shall not be held liable for any health-related complaints associated with a product rented from our site. Our products have been worn by other consumers prior to your rental.

Damaged/Soiled/Replacement Garment

  • You agree to treat our products like you would your own.
  • You will treat the garment with the upmost of care.
  • Minor Damages: If My Secret Wardrobe assesses (at its sole discretion) and there are minor damages to the dress, you may incur a fee held from your security deposit or your payment method could be charged between $10-$150 to cover minor repairs.
  • Major Damages: If My Secret Wardrobe assesses (as its sole discretion) that the dress is not repairable, you will be charged the full replacement value of the dress; as per the amount on our website.
  • Fake tans: must not be worn/used when hiring any My Secret Wardrobe products. If any dress/s come back with any source of fake tans deposits can and will be held in order to pay for extra cleaning costs.

Late Fee Policy

  • You agree to return your product on the order return date (or next business day if your return date falls on a Sunday (Post only) or public holiday by 12pm using the prepaid return satchel provided.
  • If you have selected in-store return you must return your dress on the order return date.
  • If you return your item(s) late you will incur a thirty dollar ($30.00) late fee for every day you are late. 
  • In the event your dress is booked back-to-back and you are late / no show for the next customer, your bond will be held in full. 
  • You agree to pay the late fees stated in our Terms & Conditions
  • If you have not returned your product within 5 days of the return date your product will be considered a non-return and you will be charged the full retail amount of the item(s).
  • If you lose your packaging it is your responsibility to return the items(s) to My Secret Wardrobe within the allocated return date. - You must purchase return shipping at your own expense and provide the tracking number to My Secret Wardrobe.
  • My Secret Wardrobe will not be held liable for products which are late or lost in transit due to your chosen method of shipping.
  • If you return your item(s) via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then you will not be responsible for late fees provided the item(s) are lodged by 12pm on your return date (or next business day if your return date falls on a Sunday or public holiday).

Collection

  • If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collections, including and without limitation attorney and collection fees.
  • My Secret Wardrobe reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.

Title To Hired Apparel

  • The Apparel is and will at all times remain the absolute property of My Secret Wardrobe.
  • If the User fails to return the Apparel to My Secret Wardrobe then My Secret Wardrobe or My Secret Wardrobes agent may (as the invitee of the User) enter upon and into land and premises owned, occupied or used by the User, or any premises where the Apparel is situated and take possession of the Apparel.

Cancellations & Credit Note Policy

You may cancel your rental order subject to the following cancellation fees and policies:

  1. Cancellation fourteen (14) or more days in advance of the delivery date, there is a $30 cancellation fee and you will receive a full credit note. Available to use 3 months from cancellation day.
  2. If you cancel less than fourteen (14) days but more than seven (7) days in advance of the delivery date, you will be charged a $30 cancellation fee & you will not receive any refund, but you will receive a 50% credit note for the Hire Fee associated with the cancelled order. (This credit can be applied to any future hires placed within 3 months of the cancellation date).
  3. If you cancel seven (7) or fewer days in advance of the delivery date, you will not receive a credit note or a refund.

Please Note: 

  • Credits may not be used on existing orders only new orders.
  • Credit notes can not be split.
  • Under no circumstances do we issue refunds due to cancellations.
  • Credit notes can not be used on custom made orders.
  • The customer may change the order to another item of the same value or more. 
  • Change or cancellation fees is deducted from from the deposit/ amount paid before applying a credit.
  • Cancellations will not be accepted on days where there was a sale or a promo offer.

All orders placed using After Pay or Zip Pay will incur a $14.95 cancellation fee in addition to the $30 store cancellation fee.

COVID 19 Terms & Conditions

  • The above policy (Cancellation & Credit Note Policy) applies to all orders cancelled due to COVID-19: 

Try-Ons

  • By choosing to try-on a dress you are accepting our Terms and Conditions.
  • Unless specified try-ons will be sent via regular express.
  • If you require the item to be signed for then you must specify this when organising a try on.
  • If you do not and the parcel is lost you may be responsible for the associated fees.
  • Please note try-ons are not available between the 1st of September and the 31st of January

Use of My Secret Wardrobe Products

  • You agree to treat our products like you would your own.
  • You will treat the garment with the utmost of care.
  • You will not attempt to fit into a dress that is too small for you.
  • You will not try and zip up a dress that is too tight and therefore damage the zip.
  • All zips are inspected prior to sending the garment out, therefore if you damage a zip, you will be required to pay for the repair. ($50 Zipper Replacement)

Bond

A bond of $100-$150 per item is payable at the time of entering into this hire contract and the following terms and conditions apply: 

  • If the item is returned in its original undamaged condition the full bond is refunded to the customer.
  • If the item is returned with a faulty zipper the sum of $50 will be deducted from the bond to cover the cost of repair.
  • If the dress is returned in a damaged condition where damages include stains tears dirt marks, the cost of repairs and or dry cleaning will be deducted from the bond. An invoice upon request can be issued to the customer to verify the charges claimed.
  • In the event the repairs exceeds the bond held the customer will be liable for the difference in full immediately. (Unless advised otherwise due to payment plan in place)
  • In the event the damage to the item it is so severe that it is deemed irreparable then the customer hereby accepts to be liable for the recommended retail price of the dress. MSW will provide the customer with an invoice setting out the sum payable and the customer must attend to payment of that sum immediately.

Alternations (Applies To In-Store Hires)

  • It's the customers responsibility to ensure that any alterations ordered and paid for have been attended to in accordance with the customers original instructions.
  • MSW recommends that the customer try the item on at the time of pick up to ensure the alterations attended to accord with the customers original instructions.
  • In the event the alterations attended to before leaving the store do not apply with the customers original instructions, it is the responsibility of MSW to ensure that those alterations are immediately attended to.
  • Once the item has left the premises of MSW, MSW will not be held liable for any discrepancy between the customers instructions and the alterations attended to by or on behalf of MSW.
  • MSW highly recommends if you have had alterations made to a gown to be the person present at time of pickup/collection. If someone else other then the original customer has been sent to collect the dress on behalf of the customer having alterations made MSW holds no liability on any faults once the dress has been taken out of the store.

Credit Note & Gift Cards

  • One credit note only can be applied per order.
  • Credit notes/gift cards issued have an expiry and are valid on HIRE items only (NOT clearance stock or sale/promos).
  • Credit notes have a 3 month expiry and gift cards issued have a 12 months expiry.
  • Orders placed using credit notes are final and cannot be refunded or exchanged for another credit note.
  • Credit notes can only be used on new order not existing orders.

Email

We will use the information from your order to send you email marketing on occasion such as discounts, sales and special offers. We don’t however pass on any of your details including your email address to any other companies or corporations. You may opt out of receiving those emails by emailing info@mswthelabel.com

MSW hours of operation are: 

  • Monday to Friday - 10:00AM - 4:30PM
  • Saturday - 10AM - 4PM
  • Sunday - 10AM - 3PM
